Towards the end of January 2023, Genesee and Wyoming Inc. had got into a legal settlement with the federal government for violating the Clean Air Act (CAA), and as a consequence for failing to go with court rulings, the Genesee and Wyoming had been forced to retire 88 diesel locomotives from the rosters on the majority of their railroads they owned. Most of these diesel locomotives were units from the first and second generation of diesels. Aside from having to pay a $1.3 million ($1,323,994.59 in 2024) penalty they stated that none of the locomotives would be preserved as they must be "permanently destroyed" and be replaced by newer locomotives.[1]
Genesee and Wyoming Inc. had originally stated that they would rebuild their older locomotives to comply with new EPA regulations, but either didn't rebuild them or just falsified the paperwork just to get away with it, however, its unknown why they didn't rebuild their older locomotives to comply with new EPA regulations.[1]
